Highlights of the report:

  • OCR determined that there was a statistically significant disproportionate number of white disabled students placed in out of District schools in 2010-11 as compared to non-white disabled students For years 2011-12, 2012-13 and 2013-14
  • OCR determined that there was a significant disproportionate number of white students classified with an Intellectual disability in out-of- district placements compared to non-white students
  • OCR determined that there was a significant disproportionate number of white students classified with emotional disturbance in out of district placements for 2011-12 and 2013-14
  • OCR determined that for 2013-14 it found no support in IEPs for students in the Yiddish and Spanish bilingual special education programs to indicate that any of the students were identified as English language Learners, or that they were screened for English proficiency using diagnostic evaluation
  • OCR found that in 2013-14 six of the IEPs of students in the Yiddish bilingual special education program did not include any reference to the need for bilingual special education, much less indicate how student’s language needs related to the IEP
  • OCR noted that in the same year none of the IEPs of students in the Spanish bilingual special education classes indicated any need for bilingual education
  • OCR noted that the District invited parents of Yiddish speaking students, who received special education services or early intervention services during the 2012-2013, were invited to attend an open house for the bilingual special education program in August 2013 and that rabbis in the community were invited to attend. OCR indicated the District did not conduct an open house for the parents of students in the Spanish bilingual special education program
